Work out what your employer owes you when your contract ends in Spain: pay for the last days, extra payments, holidays and severance pay.
| Item | Amount |

The finiquito is the final settlement your employer pays when your contract ends, whatever the reason. Even if you resign, you are always entitled to it. It includes three things:
Severance pay (indemnización) is separate: you only receive it in some cases, such as a dismissal or the end of a temporary contract.
| Reason | Days per year worked | Maximum |
|---|---|---|
| Resignation | 0 | — |
| Fair disciplinary dismissal | 0 | — |
| End of temporary contract | 12 | No limit |
| Objective dismissal (despido objetivo) | 20 | 12 months' pay |
| Unfair dismissal (despido improcedente) | 33 | 24 months' pay |
For contracts signed from 12 February 2012. For older contracts, the time worked before that date is paid at 45 days per year; ask a professional about your case.
A day's pay is your gross annual salary, extra payments included, divided by 365. Years worked count with decimals: three and a half years are 3.5 years.
| Reason | Severance pay | Total gross |
|---|---|---|
| Resignation | €0 | €2,753 |
| End of temporary contract | €2,864 | €5,617 |
| Objective dismissal | €4,774 | €7,527 |
| Unfair dismissal | €7,877 | €10,630 |
Contract from 1 March 2023 to 15 October 2026, 14 payments and 10 holiday days taken in 2026.
The salary, extra payment and holiday parts are normal pay: Social Security and income tax are deducted from them. Severance pay for dismissal or for the end of a temporary contract is exempt from income tax up to the amount set by law (with a €180,000 limit) and has no Social Security deductions.
You can sign it as no conforme (not in agreement) if you disagree with the amounts. That way you receive what they pay and keep the right to claim the rest.
Usually yes, with the notice period set by your collective agreement, often 15 days. If you do not give notice, your employer can deduct the missing days from your settlement.
If you were dismissed or your temporary contract ended, yes, as long as you have contributed at least 12 months. If you resigned, no. Use the unemployment benefit calculator to see how much.
